Terms of Service

1. Acceptance of These Terms
These Terms of Service (“Terms”) govern your access to and use of joya.coach (the “Website”) and all memberships, coaching, workshops, retreats, educational content and other services provided by Joya (“Joya”, “we”, “our” or “us”).
By accessing the Website or using our Services, you acknowledge that you have read, understood and agree to be bound by these Terms.
If you do not agree with these Terms, please do not use the Website or our Services.
2. Definitions
For the purposes of these Terms:
Website means joya.coach.
Services means all memberships, coaching, workshops, retreats, classes, educational resources, digital content and any other products or services offered by Joya.
Membership means any recurring subscription offered by Joya.
Participant, Member, you and your refer to any individual or organization accessing the Website or using our Services.
3. About Joya
Joya provides educational wellbeing services designed to support individuals and organizations through meditation, coaching, workshops, retreats and related educational resources.
Our approach integrates meditation, Kriya Yoga, Ayurveda and contemporary scientific understanding of wellbeing.
Our Services are educational and supportive in nature and are intended to encourage personal growth, healthier habits and overall wellbeing.
Joya may modify, improve or discontinue Services from time to time as our offerings evolve.
4. Memberships, Billing & Payments
4.1 Memberships
Certain Services are offered through recurring Memberships.
By purchasing a Membership, you authorize Joya or its designated payment processor to automatically charge your selected payment method according to the Membership selected during checkout until your Membership is cancelled in accordance with these Terms.
Unless otherwise specified:
Memberships renew automatically.
Payments are processed in advance of each billing period.
Prices are displayed in Canadian dollars.
Applicable taxes are added where required by law.
You are responsible for maintaining accurate billing information and a valid payment method.
4.2 Initial Membership Commitment
Unless otherwise stated, Memberships include an initial commitment of three (3) consecutive months.
This commitment reflects the nature of our programs, which are designed to encourage consistency while allowing Joya to appropriately plan coaching availability and member support.
Following the initial commitment period, Memberships continue on a month-to-month basis until cancelled.
Nothing contained in these Terms limits any rights available under applicable law.
4.3 Automatic Renewal
Following the initial commitment period, your Membership automatically renews at the beginning of each billing cycle unless cancelled before the next renewal date.
4.4 Cancellation
Membership cancellations may be requested at any time by emailing:
Where the initial commitment has been completed, cancellation becomes effective at the end of the current billing period.
Where cancellation is requested before completion of the initial commitment, the request will be processed in accordance with these Terms and applicable law.
4.5 Refund Policy
Unless required by law or otherwise agreed in writing:
Membership fees are non-refundable.
Partially used billing periods are not refunded.
Missed appointments are considered completed.
Digital content becomes non-refundable once access has been granted.
Retreat or event deposits may be non-refundable where disclosed prior to registration.
If Joya cancels a paid Service and is unable to provide an appropriate alternative, we may offer a replacement Service, account credit or refund for the affected portion.
4.6 Failed Payments
If payment cannot be processed, Joya may request updated payment information.
Access to Membership benefits or Services may be temporarily suspended until outstanding payments have been resolved.
5. Scheduling & Attendance
Private appointments may be rescheduled with at least twenty-four (24) hours’ notice.
Appointments cancelled with less notice, or missed without prior communication, may be considered completed.
Reasonable exceptions may be made where unexpected circumstances arise.
6. Workshops, Retreats & Corporate Programs
Additional terms may apply to workshops, retreats and corporate wellbeing programs.
These terms may include registration requirements, payment schedules, venue policies, travel arrangements or cancellation deadlines.
Where Services are provided under a separate written agreement, that agreement will govern the applicable engagement.
Unless otherwise stated, participants remain responsible for their own travel, accommodation and personal expenses.
7. Wellness Disclaimer
Joya’s Services are educational in nature and are designed to support personal wellbeing through meditation, coaching and related educational practices.
Our Services are not intended to diagnose, treat, cure or prevent any medical or mental health condition, nor are they a substitute for professional medical, psychological or psychiatric care.
If you have concerns regarding your physical or mental health, are pregnant, are receiving treatment, or are unsure whether participation is appropriate for you, we encourage you to consult a qualified healthcare professional before beginning any new practice.
Participation in Joya’s Services is voluntary. We encourage every Participant to listen to their body, respect their own limits and practice at a pace that feels safe and appropriate.
8. Client Responsibilities
By participating in Joya’s Services, you acknowledge that you remain responsible for your own decisions, actions, wellbeing and healthcare.
You agree to:
Participate respectfully and in good faith.
Provide accurate information where reasonably necessary for the delivery of Services.
Communicate relevant concerns that may affect your participation.
Use Joya’s Services in a safe and responsible manner.
Respect other participants, instructors and members of the Joya community.
Your experience and progress ultimately depend upon your own participation, consistency and individual circumstances.
9. Results
Meditation, coaching and personal development are personal experiences that vary from one individual to another.
While many participants experience meaningful benefits, Joya does not guarantee any particular physical, emotional, psychological, professional, financial or spiritual outcome.
Testimonials shared by participants reflect individual experiences and should not be interpreted as guarantees of future results.
10. Confidentiality
Joya recognizes the importance of privacy and strives to create an environment built on trust and respect.
Information voluntarily shared during private coaching sessions will be treated with discretion and will not be disclosed except:
with your consent;
where required or permitted by law; or
where disclosure is reasonably necessary to protect the safety of an individual.
Participants in group programs are expected to respect the privacy of others. While Joya encourages confidentiality within group settings, it cannot guarantee the conduct of other participants.
11. Community Standards
Joya is committed to maintaining a welcoming, respectful and inclusive environment.
Participants are expected to conduct themselves with kindness, professionalism and respect toward others.
Harassment, discrimination, intimidation, fraudulent activity, repeated disruption or conduct that materially interferes with the experience of others may result in suspension or termination of participation.
Where appropriate, Joya will make reasonable efforts to resolve concerns through respectful communication before taking further action.
12. Intellectual Property
Unless otherwise indicated, all content made available by Joya—including text, graphics, logos, branding, guided meditations, recordings, videos, written materials, educational resources, course materials and digital content—is the exclusive intellectual property of Joya and is protected under applicable intellectual property laws.
Subject to these Terms, Joya grants you a limited, personal, non-exclusive, non-transferable and revocable licence to access and use purchased materials solely for your own personal, non-commercial use.
Without Joya’s prior written consent, you may not:
reproduce or distribute our materials;
modify or create derivative works;
publish, sell or sublicense our content;
share Membership access or digital resources with others;
use our content for commercial purposes; or
remove any copyright, trademark or proprietary notices.
Nothing in these Terms transfers ownership of Joya’s intellectual property to you.
13. Recording of Sessions
Certain workshops, classes or educational sessions may be recorded for the benefit of registered participants.
Where recording takes place, participants will be informed in advance whenever reasonably possible.
Private coaching sessions will not be recorded without your prior knowledge and consent.
Participants may not record, photograph, reproduce or distribute Joya sessions or materials without prior written authorization.
14. Limitation of Liability
Joya strives to provide thoughtful, professional and high-quality Services delivered with care.
Participation in our Services is voluntary, and you acknowledge that you remain responsible for your own decisions, actions and wellbeing.
To the fullest extent permitted by applicable law, Joya shall not be liable for any indirect, incidental, consequential, special or exemplary damages arising from or relating to the use of our Website or Services, including any loss of income, business opportunity, data or anticipated benefits.
Nothing in these Terms excludes, limits or modifies any rights or remedies that cannot legally be excluded under applicable law.
15. Suspension or Termination
Joya reserves the right to suspend or terminate access to the Website or its Services where reasonably necessary, including in circumstances involving:
repeated non-payment;
fraudulent or unlawful activity;
misuse of Joya’s content or Services;
material breaches of these Terms; or
behaviour that threatens the wellbeing, safety or experience of other participants or members of our team.
Where reasonably practicable, Joya will provide notice and an opportunity to resolve the issue before suspension or termination.
16. Force Majeure
Joya shall not be responsible for any delay, interruption or failure to perform its obligations where such delay or failure results from events beyond our reasonable control, including natural disasters, severe weather, public health emergencies, labour disruptions, internet outages, government actions or other unforeseen circumstances.
Where reasonably possible, affected Services will be rescheduled or suitable alternatives will be offered.
17. Changes to Services
Joya reserves the right to modify, improve, suspend or discontinue any Service, Membership, feature or offering where reasonably necessary.
Where a material change affects an active Membership, reasonable efforts will be made to communicate those changes in advance.
18. Changes to These Terms
Joya may revise these Terms from time to time to reflect changes in our Services, business operations or applicable legal requirements.
The most current version will always be published on joya.coach and will become effective on the date indicated at the beginning of these Terms.
Your continued use of the Website or our Services following the effective date of any revisions constitutes acceptance of the updated Terms, to the extent permitted by applicable law.
19. Severability
If any provision of these Terms is determined to be invalid, illegal or unenforceable by a court of competent jurisdiction, that provision shall be be interpreted to the minimum extent necessary or severed from these Terms without affecting the validity or enforceability of the remaining provisions.
20. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the Province of Quebec and the applicable federal laws of Canada.
Any dispute arising from these Terms or the use of Joya’s Services shall be subject to the jurisdiction of the competent courts of the Province of Quebec.
21. Entire Agreement
These Terms constitute the entire agreement between you and Joya regarding your use of the Website and our Services and supersede any prior understandings or agreements relating to the same subject matter.
Failure by Joya to enforce any provision of these Terms shall not constitute a waiver of that provision or of any other rights available to Joya.
